McDonald's Set to Phase Out Suppliers' Use of Sow Crates

monster beats The McDonald's Corporation said on Monday that it would begin working with its pork suppliers to phase out the use of so-called gestational crates, the tiny stalls in which sows are housed while pregnant. Animal rights advocates have singled out the crates, known as sow stalls, as inhumane, and several states have moved to ban or restrict their use not only in pork production, but also in the production of eggs and veal."McDonald's believes gestation stalls are not a sustainable production system for the future," Dan Gorsky, senior vice president for supply chain management for McDonald's North America, said in a statement. "There are alternatives we think are better for the welfare of sows." At a little more than 2 feet by 7 feet, sow stalls are too small for a pregnant pig to turn around. Being confined in a stationary position for the four months of an average pregnancy leads to a variety of health problems, including urinary tract infections, weakened bone structures, overgrown hooves and mental stress, according to animal rights advocates.

monster headphones About 60 to 70 percent of the more than five million breeding sows in the United States are kept in the crates. Several large suppliers, including Smithfield Farms and Cargill, have already begun reducing their use of the crates, but a large portion of the pork supply still comes from pigs born from sows raised in crates, Bob Langert, McDonald's vice president for sustainability, said in an interview. "When we were looking at this over the last year, we could see more needed to be done." McDonald's has asked its five direct suppliers of bacon, Canadian bacon and sausage to provide their plans for reducing reliance on sow stalls. It said it would assess those plans and announce what steps it might take in response in May."It's not a simple process," Mr. Langert said. "We buy a finished product from our suppliers, who are buying from a processing facility that is buying from producers and farmers who raise the pigs - who in turn are buying piglets from farmers who have the sows. There are lots of stakeholders and collaboration that are going to be involved."

beats by dre headphones Dr. Jodi Sterle, an expert on swine reproductive management at Iowa State University, said no easy alternative to sow stalls existed because feeding pigs is complicated by their hierarchical nature. "When they are raised in groups, there is competition for food, water and space, and especially for food," she said. Producers have tried a method called trickle feeding, in which small amounts of food are put into feeders throughout the day, but dominant sows tend to camp out by the feeders and push more passive animals away. Another method uses a microchip embedded in an ear tag to manage a sow's diet and feed her in a "cafeteria," but animals sometimes find ways of overcoming that technology, too. "Basically, there's no science that provides the perfect answer right now," Dr. Sterle said. The National Pork Producers Council, a trade association, said in a statement that it supported the McDonald's effort. "Pork industry customers have expressed a desire to see changes in how pigs are raised," the council said. "Farmers are responding and modifying their practices accordingly."

beats by dr dre During the last decade, the Humane Society of the United States has worked to raise awareness of the problems caused by the use of restrictive crates in the meat and poultry industry. Several states, including Florida and California, have passed laws banning the use of restrictive crates in meat and egg production. The Humane Society has been in contact with McDonald's over the years about the crate issue but had stepped up the intensity of its discussions over the last month, according to Wayne Pacelle, the society's president. The buying power of McDonald's adds a significant new dimension to the war on the practice. "I would go so far as to say that while we've been able to pass laws against gestation crates that are very important, this announcement by McDonald's today does more to put the writing on the wall for the pork industry than anything that's happened previously," said Paul Shapiro, senior director for farm animal protection at the Humane Society.

dre beats McDonald's buys just 1 percent of the total pork produced in the country, but its influence is much larger. When the company required its egg suppliers to increase the amount of cage space devoted to their hens in 1999, for example, other fast-food chains followed suit and soon the vast majority of egg producers had given their chickens more space. Burger King was the first large fast-food chain to reduce its purchases of pork produced in facilities that use gestation crates, taking that step in 2007 at the same time it began adding cage-free eggs to its supply chain, according to the Humane Society. Before that, the celebrity chef Wolfgang Puck announced that he would stop serving foie gras, which is the liver of force-fed geese, and no longer buy veal, pork or eggs from producers that use restrictive crates. In 2007, Smithfield Foods, the world's largest pork producer, pledged to end the use of gestation crates in the facilities it owns by 2017, a date it postponed during the economic downturn. The Humane Society then conducted an undercover investigation, releasing video of pigs in Smithfield's stalls, and the company once again pledged to stop using the crates by 2017.

The Humane Society said that Cargill is 50 percent crate-free now, and Hormel Foods recently announced that it would match Smithfield's pledge.

Europe Struggles Over Greek Details

beats by dre European Union negotiators have yet to settle key elements of a complex bailout and debt-restructuring package for Greece-including how euro-zone governments will contribute to a desired cut in the country's debt burden-ahead of a pivotal meeting this week. The Greek Parliament's backing for a deeply unpopular package of spending, wage and pension cuts, which sent European stocks and the euro higher on Monday, has shifted the focus of negotiations back to Brussels, ahead of a meeting of finance ministers due to start here Wednesday afternoon. Central to the negotiations is resolving the thorny issue of how Greece's official creditors in Europe-other euro-zone governments and the European Central Bank-should participate in the debt restructuring. Euro-zone leaders are expected to make the final decision on the new bailout at their summit in March.

dre beats That would be one of the final pieces of the puzzle to fall into place to allow approval of at least €130 billion ($171.5 billion) in bailout loans from the euro zone and the International Monetary Fund that should avert a potentially chaotic Greek debt default next month. But he said other conditions needed to be fulfilled. They included identifying €325 million of extra budget cuts this year and, his spokesman said, "clear assurances from [Greek] political party leaders before they embark on the campaign for the next election." Even after Wednesday's meeting, legislators in some countries, including Germany, will be required to have their say before the bailout aid will be released. Germany and Greece's other official creditors have sought to tie the hands of Greek politicians after elections expected in April, seeking assurances they will back the unpopular package after then.

beats by dr dre But in his public statements, the man opinion polls suggest will be the likely next prime minister, Antonis Samaras of the New Democracy party, has delivered less than wholehearted backing for the program. "I want to avoid the jump over the cliff today, to buy time, to restore normality and to go to elections tomorrow," he told Parliament on Sunday. "This is why I ask you to vote in favor of the new loan agreement today and to have the ability tomorrow to negotiate and to change the current policy which has been forced on us." German Chancellor Angela Merkel explicitly opposed that on Monday. "An amendment to the program can't and won't happen," she told a news conference. A crucial question confronting negotiators in Brussels is whether to stick to a target set by euro-zone leaders in October for reducing Greece's debt burden, now about 160% of gross domestic product, to "around" 120% of GDP in 2020.

cheap beats by dre  Officials said the target may be lifted to no more than 125% of GDP as part of a final deal. Both the governments and the euro zone's central banking system are expected to give Greece some debt relief to ensure its debt falls below the 125% target in 2020, European officials said. But it remains to be seen exactly how. On the table is a trade-off: The governments would agree to lower the interest rate on the loans made to Greece under the bailout it received in May 2010, and in exchange the ECB or the national central banks would agree to have their holdings of Greek bonds repaid at below their full face value. "Nobody is going to put their cards on the table until Wednesday at midnight," said one official involved in the talks. The interest rate on loans from the first bailout, which has already been lowered once, now stands at 3% for the first three years of a loan and then 4% after that.

beats by dre studio Also under discussion is a move that could complicate a bond exchange intended to reduce the debt Greece owes its private-sector creditors by around €100 billion. Investors participating in the exchange will receive new Greek bonds with decadeslong maturities and €30 billion of "sweeteners"-either cash or short-term bonds issued by the European Financial Stability Facility, the euro zone's temporary bailout fund. The governments are now considering whether the sweeteners can be reduced and the extra money used to help close a financing gap expected for the Greek government over the next eight years, officials said. But that step might discourage investors from participating in the exchange, undermining Europe's goal of having the debt exchange described as "voluntary."

beats solo The bloc's central banking system might participate in two ways. First, the ECB bought Greek bonds with an estimated face value of about €50 billion on the secondary market over the previous two years in a futile effort to drive down Greek bond yields. The central bank bought those bonds at sharp discount; the idea is that the ECB could forgo profit it would earn if the bonds were repaid in full and instead distribute the profit back to the national governments, which would then hand the money over to Greece. Second, the national central banks of the euro zone hold an estimated €12 billion of Greek bonds on their investment portfolios. The national banks might simply accept losses on these bonds, officials said.

FHA a beneficiary in mortgage settlement

dr dre headphones The landmark $25 billion settlement with banks last week over fraudulent foreclosure practices might aid more than struggling homeowners. Part of the proceeds also will help plug a projected shortfall in the reserves of the Federal Housing Administration. Shaun Donovan, secretary of Housing and Urban Development, said in a conference call with reporters Monday that the financial firms involved in the settlement agreed to provide up to $1 billion to shore up the capital reserve fund of the FHA, which provides mortgage insurance on loans made by approved lenders throughout the country. The Office of Management and Budget estimated that the FHA's capital reserves could be depleted this year, leaving a nearly $700 billion shortfall and potentially forcing the self-funded agency to seek aid from the Treasury for the first time since its creation in 1934.

beats headphones But Donovan said Monday that the deal with banks would make such talk a moot point. In addition to the settlement payments from banks, Donovan said the agency would increase its mortgage insurance premiums again this year, a move that also could help the FHA bolster its finances. While the government is legally required to ensure that the balance in the FHA's emergency reserve fund does not drop below 2 percent of outstanding FHA loans, the agency's reserves have sunk below that threshold in recent years because of the housing crisis. Under law, if the FHA's reserves were depleted entirely, the agency would automatically receive payments from the Treasury to make up for the deficit, a form of aid that the agency has never needed.

dr dre beats headphones Officials have maintained that taxpayer funding will not be necessary to back the agency, in part because the FHA has the ability to raise cash through higher premiums and because any improvements in the housing market would ease the pressure on FHA's bottom line. In fact, projections show that while the agency could further exhaust its reserves in the coming months, it should return to more solid financial footing by 2013. MS&AD Insurance dropped 2.7 percent after it forecast a net loss of 145 billion yen ($1.9 billion) for the year to March, compared with a previous estimate of a 6 billion yen net profit. The non-life insurer said it now expects 236 billion yen in payouts. Peers NKSJ Holdings Inc (8630.T) shed 3 percent and Tokio Holdings Inc (8766.T) eased 0.8 percent, while the insurance subindex .IINSU.T fell 1.1 percent to be among the worst sectoral performers.

beats by dre "We are struggling at the 9,000 level ... There isn't a jolt in the market to really lift the whole thing higher," a sales trader at a foreign brokerage said, but adding that the recent increase in buying by foreign investors was a positive. The benchmark Nikkei is up 6.2 percent so far this year as a brightening outlook for the U.S. economy and an injection of 489 billion euros ($646 billion) of three-year loans by the European Central Bank to boost liquidity outweighed disappointing Japanese corporate earnings. Equity mutual funds based in Japan suffered net outflows for a fourth straight month in January, the longest such spell in 15 years, though a recovery in global share prices pushed up asset value by nearly 3 percent.

cheap beats by dre The Bank of Japan ends a two-day policy meeting on Tuesday, and although the market consensus is for no policy shift, some analysts say it may expand its 55 trillion yen ($710 billion) liquidity-boosting program by raising the 20 trillion yen asset-buying portion, mostly by purchasing more Japanese government bonds. Other decliners on Tuesday included Nomura Holdings, down 1 percent after Bank of America Merrill Lynch downgraded Japan's largest investment bank to "underperform" from "neutral," saying the recent rally in the stock had taken above its fair value. Nomura has risen 33 percent this year after last year's nearly 55 percent battering. Bank of America Merrill Lynch also cut Daiwa Securities Group Inc (8601.T) to "underperform" from "neutral." Daiwa Securities shares were down 1.1 percent.

Apple Stock Breaks $500 Level, Continuing Rally

louis vuitton official outlet Apple's stock broke above $500 for the first time Monday. It was the latest step in a rally that began more than two weeks ago, when the company reported staggering sales and profits for the holiday quarter. The shares hit $503.83 soon after opening, before subsiding to $502.60 in after-hours trading. That was up $9.18, or 1.9 percent, from Friday's close. Apple Inc. and Exxon Mobil Corp. have been vying for the position as most valuable company in the world since last summer, but the latest rally has made the gadget maker 17 percent more valuable than the oil company. Its market capitalization is now $465 billion, compared to Exxon's $400 billion. On Jan. 24, Apple posted net income of $13.06 billion for the quarter that ended in December, more than doubling its profits from the year before. Sales were $46.3 billion, up 73 percent from a year ago.

louis vuitton online outlet Even before it posted blow-out results, Wall Street analysts had pointed to a big gap between Apple's share price and its earnings. By common methods of valuation that compare a stock price to earnings and earnings growth, the stock should be worth much more. The average target price of Apple shares given by 37 analysts who have updated their ratings since the Jan. 24 report is $588, according to FactSet data. Analysts say the company's policy of keeping its cash rather than paying a dividend has been hurting the stock. Value-oriented funds are often forbidden from investing in companies that don't pay a dividend, and growth-focused funds are often tapped out - they're heavily invested in Apple already, and likely don't want to increase their holdings. However, company watchers expect Apple to start paying a dividend this year.

louis vuitton handbags outlet On a conference call after the earnings report, chief financial officer Peter Oppenheimer said the board was in "active" discussions about the company's use of cash. Apple looks set to launch sequels in its hit iPhone and iPad franchises this year. There's also speculation that it will move into the TV market. The company that runs the Depression-era skyscraper, the tallest building in New York, is planning to go public in a stock offering that could raise $1 billion, according to documents filed with regulators Monday. That means that even if you can't afford to buy a home, you can buy a stake in perhaps the nation's most iconic office building. At least until the government sells shares in the Pentagon. The planned IPO comes about 10 years after real estate investor Peter Malkin bought the 102-story Art Deco landmark from Donald Trump and a business partner for $57.5 million.

louis vuitton handbags on sale It's the latest chapter in a saga that dates to 1931, when the building was completed, establishing it as the city's tallest skyscraper. It regained that standing after the collapse of the World Trade Center twin towers in the Sept. 11 attacks. Millions of tourists visiting New York ascend its heights to gape over the city from its observation deck, made famous in films such as "Sleepless in Seattle." It was 1933's King Kong that showed a giant ape clutching Fay Wray and fending off airplanes atop the tower. The building's star turns in Hollywood blockbusters and TV shows and its dominant presence in the New York landscape have made it among the most beloved structures in the nation. And the opportunity to buy stock in a company that owns such a landmark doesn't come up often.

louis vuitton bags outlet Some of the nation's marquee buildings are owned by publicly traded companies. Boston Properties owns the General Motors building in New York and the Embarcadero Center in San Francisco's financial district. But neither has the history that the Empire State Building has. "You have a trophy property that is irreplaceable," says Hessam Nadji, managing director for research and advisory services at Marcus & Millichap, a commercial real estate services firm. In its regulatory filing Monday, Empire State Realty Trust Inc. didn't say how many shares might be involved in the IPO or what price they might fetch. The $1 billion figure isn't final, either. It's subject to investor demand. The company, the predecessor of which is Malkin Holdings LLC, plans to use proceeds to pay investors, repay loans and cover the expenses of the IPO and the company's formation last summer, as well as for possible future acquisitions.

cheap louis vuitton bags Empire State Realty, which owns and operates 12 properties in Manhattan and greater New York, expects to trade on the New York Stock Exchange under the stock ticker symbol ESB. By going public, Empire State Realty will be able to tap the equity markets for capital, something real estate investment trusts have had a lot of success doing, even in a wobbly economy. Marcus & Millichap's index of REITs has doubled since the bottom of the recession. Commercial real estate has also been improving, particularly in New York. The city's office market bounced back after the financial crisis in 2008 led to sweeping job losses on Wall Street and companies pulled back on space. The office vacancy rate stood at 10.5 percent at the end of last year, down from a peak of 13 percent in 2009, Nadji said. That is still well above the 6 percent vacancy rate in 2007, but New York's office market remains the lowest in the nation among major metropolitan areas, he said. Rents also have been rising, particularly for prime office buildings.

louis vuitton shoes outlet Still, there's a difference between a unique, historic building and a property that can draw the highest rental rates, says Rob Stevenson, head of U.S. REITS at Macquarie Capital (USA) Inc. "You can't find too many buildings in this country that are more iconic than the Empire State Building," Stevenson says. "But if you're talking about a trophy building - that's definitely not the Empire State Building." He says that the skyscraper is not well suited as space for financial services companies and other large tenants, who typically prefer more modern buildings. He adds that its location is not as desirable as a building in the Plaza District, an expensive zone in midtown Manhattan. The Empire State Building's owners have sought to modernize the 80-year-old tower.

louis vuitton shoes for men In 2009, they embarked on a $550 million renovation aimed at making it more environmentally friendly and energy-efficient. The owners said they need $55 million to $65 million beyond 2013 to finish upgrades. Apart from the novelty factor, will investors see the Empire State Building as a good real estate investmentJohn Fitzgibbon, founder of IPOScoop.com, which tracks IPOs, says investors won't get a good sense of the value of the IPO until the company provides more complete information on the offering. But he says IPOs by real estate investment trusts generally don't make much of a splash. On the surface, Mr. Volcker would seem right. But if you dig deeper into the complex needs of global corporations that are the clients of big banks these days, they sometimes seek banks to make proprietary bets to help them. In such cases, companies may now look to overseas firms.

Having said all of that, even after adding up all of the costs, the Volcker Rule still makes a whole lot of sense. In the long term, it will prevent banks from taking outsize bets and putting taxpayers at risk. But just remember, this change doesn't come without a price.

The $13,000 adoption tax credit is back

cheap louis vuitton belts An adoption tax credit that brought huge refunds to many unsuspecting families last year is back. Taxpayers can claim up to $13,360 for each child they have adopted in the past six years on their 2011 tax returns this year -- an increase of $190 from last year. The credit has been around since 1997, but up until the 2010 tax year, it was always a non-refundable credit -- meaning it would offset any taxes owed, and anything that remained was carried over to the next tax year.  President Obama's Affordable Care Act of 2010 made the credit refundable so the money would go directly into the taxpayer's pocket rather than being applied to future taxes owed.  But, unless Congress extends the credit by the end of this year, the 2011 tax year will be the last year that taxpayers can cash in on the credit.

replica louis vuitton handbags A 'godsend': The newly refundable credit has been especially helpful for families adopting "special needs" children. While families adopting children who do not qualify as special needs are typically eligible to get a refund for their adoption expenses, families adopting kids who do qualify can get the entire $13,360 refund no matter how much they paid to adopt a child -- even if they had no expenses. Generally, a child with special needs is someone who the state determines wouldn't be adopted without its assistance. Special needs qualifications vary by state and are determined by such factors as medical or physical impairments, genetic conditions, minority status, number of siblings or age. Deborah Schwinger, from Hamburg, Pa. received a $24,300 refund last year thanks to the adoption tax credit.

fake louis vuitton bags uk In 2009, she adopted Matthew and Lizzy. The children, who had moved between foster homes, have speech problems and a "long list of behavioral problems" after being severely neglected by their birth mom, Schwinger said."The money was a godsend," she said. "The kids got new bikes from Walmart and I got a grill, I set up [bank] accounts for the children, I'm working to get us a bigger house, I no longer live paycheck-to-paycheck and have little debt. We have everything we need and we get a few things we want." Other families received even bigger windfalls. The Wards,a family of 12 from North Carolina, received a $54,000 refund last year. Going into the tax season, the Wards said they were completely unaware of the credit. In fact, they thought they would owe money.

cheap louis vuitton bags sale Watch out!: Since this is the biggest refundable tax credit available, the IRS isn't going to give it out to just anyone. Taxpayers seeking the credit should expect long waits and the possibility of an audit, said Amy Miller, director of the Tax Institute of H&R Block. Schwinger said she had to send in her paperwork twice last year. After a number of fruitless phone calls to the IRS, she was told that no more information was required, and to wait 45 days for her refund. After 45 days, she was told she needed to send in additional documents. It wasn't until June -- about four months after she filed her taxes -- that she finally received her full refund. She wasn't alone. In a report examining how the IRS handled adoption tax credit claims last year, the Government Accountability Office found that there were "considerable" delays due to the high level of audits the agency conducted.

louis vuitton wallet for women The GAO said 68% of the nearly 100,000 returns claiming adoption tax credits were audited last year, but the IRS only ended up requiring those taxpayers to pay more in taxes about 17% of the time. In all, $1.2 billion in adoption tax credits were claimed last year, the GAO found. Many taxpayers received the portion of their tax refund that didn't include the adoption tax credit while they waited. Schwinger, for example, received $4,350 of her refund in March that was separate from the adoption tax credit. She didn't receive the money she was owed from the adoption credit until about four months later. The IRS acknowledged the delays, and said it has updated the information on its website this year so that the required documentation is easier for taxpayers to understand.

louis vuitton wallets for men Typically, it should take three weeks for taxpayers to receive a refund if a complete and accurate paper return is submitted and correct documentation is attached. But if the IRS doesn't receive the right documentation, it will spend extra time ensuring that the claim isn't fraudulent, said IRS spokesman Terry Lemons. "When you have a credit of this size it's really important for us to make sure we have the documentation so we get it only to the people who qualify," he said. Given the huge amounts of money being claimed, Miller said that even if everything is submitted correctly, taxpayers claiming this credit will likely have to wait a couple of months or more to receive their refunds. What to know: To make sure you get your refund as quickly as possible, check the IRS website for a list of all necessary documentation.

louis vuitton mens wallets Taxpayers are required to submit a paper return when claiming this credit. Special needs adoptions that qualify for the full $13,360 credit, regardless of expense, must occur within the United States. Those who adopt children overseas may only claim qualifying expenses. Also, the refund phases out for taxpayers making more than $185,210, and families with income of more than $225,210 aren't eligible for the credit. "It's a great credit if you qualify, but there are certainly hoops you have to jump through and you have to dot all your 'i's and cross your 't's in terms of documentation," said James Toto, CPA and partner at accounting firm WeiserMazars. But while waiting was grueling at the time, Schwinger said she is just thankful that the adoption of special needs children is being encouraged.

louis vuitton jewellery "There are so many children in the system that need families," said Schwinger. "I think many families do not adopt because they can't afford the costs. There is help for them."An earlier version of this story stated that taxpayers must claim domestic adoptions in order to qualify for this credit. In fact, taxpayers may also claim international adoptions. However, they may not qualify for the full $13,360 refund. Oil prices fell toward $100 a barrel Tuesday in Asia as investors look to the latest U.S. crude supply figures for clues about demand strength. Benchmark crude for March delivery was down 37 cents at $100.54 a barrel at midmorning Singapore time in electronic trading on the New York Mercantile Exchange. The contract rose $2.24 to settle at $100.91 on Monday. Brent crude was steady at $117.93 a barrel on the ICE Futures Exchange in London.

louis vuitton jewelry replica Oil has hovered near $100 for several months amid signs the U.S. economy is improving. However, crude supplies have been rising, suggesting demand remains weak. Traders will be closely watching the latest inventory data when the American Petroleum Institute reports later Tuesday and the Energy Department's Energy Information Administration announces its weekly supply data Wednesday. Analysts surveyed by Platts, the energy information arm of McGraw-Hill Cos., predict crude inventories rose 1.9 million barrels last week. Analysts are concerned that rising U.S. gasoline prices, which hit a five-month high last week, could undermine consumer spending and economic growth. "These price increases come at a difficult time for the economy," energy consultant Cameron Hanover said in a report. "Jobs are just starting to come back and housing is starting to breathe its first breaths of life in years, and gasoline prices are back at it, ready to scuttle economic recovery through a pervasive tax that catches everyone."

In other energy trading, heating oil was down 0.4 cents at $3.16 per gallon and gasoline futures slid 0.2 cent to $3.00 per gallon. Natural gas gained 1.2 cents to $2.44 per 1,000 cubic feet.

Chesapeake Boosts Cash Goal

abercrombie and fitch outlet Natural-gas giant Chesapeake Energy Corp. is seeking to raise at least $10 billion this year, $3 billion more than previously announced, as the company tries to shore up its balance sheet and pay for new oil fields amid the lowest natural-gas prices in a decade. The company said Monday it is exploring a sale of all or part of its holdings in aging but still lucrative oil-and-gas fields in the Permian Basin in West Texas and New Mexico, and it hopes to sell a stake in an oil-rich zone in Oklahoma. Though it hasn't completed any of these transactions, the Oklahoma City-based company estimates they could help raise up to $12 billion. That is more than twice the amount it expects to pull in from operations if, the company said, natural-gas prices were to rise to $4 per million British thermal units from about $2.43 per million BTUs currently.

abercrombie outlet Shares of Chesapeake rose 2.4% to $22.66 in 4 p.m. New York Stock Exchange composite trading. Moody's Investors Service on Monday downgraded the outlook for Chesapeake's roughly $11 billion in debt to stable from positive, and some analysts saw the company's announcement as a sign of financial strain. Chesapeake declined to comment Monday. The possible outright sale of its Permian holdings "shows stress as we believe it is likely an attractive asset," Simmons & Co. analyst Bill Herbert wrote in a research note. Others found the decision surprising. Mark Hanson, a Morningstar analyst, said Chesapeake acquired about 700,000 acres in the Permian in West Texas since October."You don't just acquire that and flip it," he said. But, he said of the sale, "They'll get it done. You don't bet against that asset-sale machine."

abercrombie and fitch sale Chesapeake, the nation's second-largest gas producer after Exxon Mobil Corp., said in January that it planned to raise $7 billion to bridge the gap between the cash it generates through operations and the amount it plans to spend on drilling and paying down debt. Last month, Chesapeake said it would cut back on natural-gas production and shift rigs to hunt for more-lucrative oil, a dramatic shift amid glut-depressed prices that preceded similar moves from ConocoPhillips and others. Chesapeake, led by CEO Aubrey McClendon, has spent billions of dollars in recent years to acquire rights to drill into gas-rich shale. By drilling horizontally though the rock and breaking it up with a high-pressure slurry of water, sand and chemicals, Chesapeake and other natural-gas have flooded the market and pushed down prices.

abercrombie sale Natural-gas producers have also been battered by anemic demand for gas used for heating because of mild winter weather. But Chesapeake is particularly vulnerable because it isn't hedged against low gas prices. As it seeks to become more of an oil producer, Chesapeake has resorted to an exotic menu of financial stratagems to fund an aggressive drilling campaign. In addition to selling pipeline assets and stakes in its oil-field-service businesses it hopes will fetch $2 billion, Chesapeake is deploying two more transactions it expects will generate an additional $2 billion in the next 60 days. One is the sale of future oil and gas production from a field in the Texas Panhandle for cash up front, the 10th such deal it has done since 2007. Chesapeake is also selling preferred shares in a newly created subsidiary that will hold its Oklahoma oil-and-gas acreage, following a similar deal with its Ohio holdings that raised $1.25 billion.

abercrombie sale uk Some analysts are unnerved by this manner of raising cash, which they say creates obligations that don't show up on its balance sheet. "We believe the risks of Chesapeake's funding structure and off-balance sheet liabilities are still largely underappreciated," Sanford C. Bernstein & Co. analysts wrote in a research note Monday.A Chesapeake spokesman declined to comment Monday, saying the company was in the process of a debt offering, but Chesapeake executives have denied such transactions are a form of debt and vigorously defended them. "We have better opportunities to put that cash to work today than wait," Chief Financial Officer Domenic Dell Osso said in a January interview.

The Volcker Rule and the Costs Of Good Intentions

abercrombie and fitch uk On Monday, Mr. Volcker, the former Federal Reserve chairman who almost single-handedly rescued the United States from the stagflation crisis of the late 1970s, wrote a 2,000-word rebuke to critics of the Volcker Rule. The rule, which is part of the Dodd-Frank Act, was Mr. Volcker's brainchild: it seeks to prevent banks from making speculative bets with shareholder money that could put themselves - and taxpayers - at risk. The Volcker Rule is a noble and thoughtful effort to make the banking system safer in the long-term postfinancial crisis. Critics in the banking industry, however, say the new regulation comes with many embedded costs for the national and global economy. Here's where Mr. Volcker and I differ. He says: "Not so." I say: "C'mon. It'll cost the economy, at least in the short term."

abercrombie outlet The Volcker Rule may make sense for the long-term stability of the banking system, and this column has been supportive of the rule and its rationale. But to pretend that it is without significant costs, at least here and now, is disingenuous. The rule may be the right thing to do, but let's admit the truth: it won't be cheap. If the costs of the Volcker Rule were so de minimis, as Mr. Volcker has argued, you wouldn't see regulators, banks and even individuals submitting letters to the Federal Reserve up until the deadline for comments on Monday expressing serious concerns about the effect of the rule. Jamie Dimon, the chairman and chief executive of JPMorgan Chase, went so far as to belittle Mr. Volcker on Monday. "Paul Volcker by his own admission has said he doesn't understand capital markets. He has proven that to me," Mr. Dimon told Fox Business. (Ouch, that was harsh.)

cheap abercrombie uk As this column recently noted, a number of foreign regulators have also expressed particular concern about a provision of the Volcker Rule that could keep banks from helping clients buy and sell foreign sovereign bonds - which could, in turn, make borrowing costs for foreign countries higher. Some industry critics of the Volcker Rule say that removing big commercial banks from making their own bets will remove liquidity from the system, thereby driving up costs of everything from equities to corporate bonds. But the real debate has moved to the rules for banks involving "market making" - finding and matching buyers and sellers. The question is whether it will become so complex under the new legislation, that it will further push up trading costs for customers.

abercrombie sale An industry study estimated that the Volcker Rule could cost companies and investors more than $350 billion. That projection, which has been criticized by some economists, could be wildly exaggerated. But even half that number has to be considered substantial. Mr. Volcker, in his letter, doesn't buy the arguments. "The restrictions on proprietary trading by commercial banks legislated by the Dodd-Frank Act are not at all likely to have an effect on liquidity inconsistent with the public interest," he wrote. He also said that there should not be "a presumption that ever more market liquidity brings a public benefit." Yet Mr. Volcker doesn't offer any explanation for why it won't, except to argue that less liquidity might tamp down speculative trading.

abercrombie and fitch clearance "We are a store," Mr. Dimon said as a way of rebuttal on Monday on Fox. "Remember when the client calls JPMorgan, if we don't give them the best price, we don't get the business. But the best price is a huge benefit to them." At issue is this: Can a bank buy a series of bonds, for example, and keep some of them on their balance sheet - or to use Mr. Dimon's analogy, on the bank's store shelves - until they can find a customer? The way the Volcker Rule is currently construed, a bank can't keep any merchandise on its shelves. It needs to match a buyer and seller; the bank is simply the middleman. The problem with this becomes clear when a banking client asks for an odd lot of a certain financial product. Historically, the bank could buy, say, 1,000 bonds and hand over the 889 that its client had requested. The 111 other bonds would sit on the firm's balance sheet until it could parcel them out to other clients who wanted to buy them.

abercrombie and fitch london Now, such trades may become impossible - or at least, impossibly expensive. Regulators will be watching to make sure that banks aren't trying to mask proprietary trades as market-making. In other words, regulators are nervous that clever traders might try to buy certain financial products hoping that they increase in value and then selling them - but claiming that the products had really been purchased to help a client. Understanding the intent of each trade is going to become part of the regulatory process."We are going to have to have a lawyer, compliance officer, doctor to see what their testosterone levels are, and a shrink, what is your intent?" Mr. Dimon said.Mr. Volcker is particularly concerned about how banks may try to game the system. "Various arbitrage strategies, esoteric derivatives and structured products will need particular attention, and to the extent that firms continue to engage in complex activities at the demand of customers, regulators may need complex tools to monitor them," he wrote.

abercrombie uk Clearly, such trading is going to end up costing banks more, which in turn, will most likely pass those costs onto clients. (The rule is also going to cost Wall Street jobs, which some people, perhaps unfairly, don't seem to think is a bad thing.) Finally, he also rebutted critics who say that the Volcker Rule is going to make the United States banking business less competitive with foreign rivals who don't have such restrictions. Mr. Volcker calls such criticism "superficial," saying: "Competition in banking, here as elsewhere, is desirable for the benefits it brings in institutional efficiency and better, more economical service to customers. Any contribution of proprietary trading to customer service and competition is not at all obvious. In fact, because of the risks, the conflicts of interest and the adverse cultural influence it may well impede effective competition."

Moody's Warns U.K. On Outlook

louis vuitton outlet Moody's Investors Service downgraded six European nations and became the first ratings firm to warn the U.K.'s rating could be at risk, citing the area's weakening ability to implement measures aimed at reducing debt. The ratings firm's actions follow similar moves by Standard & Poor's and Fitch Ratings last month where multiple downgrades were made all at once. Like S&P and Fitch before it, Moody's said concerns with the debt crisis, how it is being handled and the impact on the region's various economies were at the heart of the downgrades. Moody's also noted the fragility of financial markets in Europe and the possibilities of future shocks to the system because of the crisis. The company previously said late last year it would review ratings broadly on European Union members, including those in the union that don't use the common currency.

www.louisvuittonoutletjan.com Where Moody's did deviate from recent actions by other ratings firms was in changing the outlook for the U.K. There had been no indication the U.K.'s outlook was necessarily in danger based on how other ratings firms view U.K.'s debt. Both S&P and Fitch have a stable outlook on their U.K. rating.U.K. Chancellor of the Exchequer George Osborne said the negative outlook is proof that Britain can't waver from its plans to deal with the country's debt. He said the rating firm was explicit that only thing stopping an immediate downgrade of the U.K. was the government's fiscal-consolidation plan. "This is a reality check for anyone who thinks Britain can duck confronting its debt," Mr. Osborne said. The ratings firm downgraded Italy a notch to A3, which is four rungs above speculative-grade territory, and maintained a negative outlook on the euro-zone's third-biggest economy. Malta, Portugal, Slovenia and Slovakia also received one-notch downgrades and still have negative outlooks, Moody's said. Spain was downgraded two notches.

louis vuitton outlet Each of those six countries was downgraded by S&P last month. Fitch downgraded Italy, Slovenia and Spain last month. While Moody's might have been the last to act, it was the most severe on Portugal and Spain. Among the three biggest ratings firms, Moody's now has the lowest rating on each of those countries. Concerns over Portugal's debt problems have mushroomed in recent weeks, sending its bond yields to record highs. Moody's downgrade of Portugal sends the country's rating further into junk territory at Ba3, which is three notches below investment grade. Moody's didn't go as far as S&P when it came to two top-rated euro-zone members, France and Austria. Moody's simply lowered their outlooks to negative, while S&P downgraded each of those countries.

An outlook indicates a longer time horizon, of about two years, in which a ratings action could take place. The maintenance of triple-A ratings from both Fitch and Moody's should alleviate some of the potential pressure on those two countries. Typically investors tied to minimum ratings requirements to hold debt will look to see where the majority of the big three rate debt, so France and Austria maintaining triple-A ratings at Moody's means two of three ratings firms still see them as top-notch investments.
